Acceptable Use Policy

Capitalized terms not defined here have the meaning given in Section Definitions or, where applicable, the executed Master Services Agreement.

1. Scope

This Acceptable Use Policy ("AUP") applies to Customer, all Authorized Users, and all End Users when accessing or using the Services. Section, Inc. ("Section", "we", "us", "our") publishes this AUP to set out the conduct standards that protect the Services, other customers, and the public.

Customer is responsible for ensuring that its Authorized Users and End Users comply with this AUP. The MSA, the Platform Terms of Use, and the AI Addendum carry related obligations that this AUP does not replace.

2. Prohibited content

You may not submit, transmit, upload, or store content through the Services that:

1. is unlawful, fraudulent, deceptive, or violates a third party's rights;
2. infringes any patent, copyright, trademark, trade secret, publicity, or privacy right;
3. is defamatory, harassing, threatening, or discriminatory on the basis of race, color, religion, sex, gender identity, sexual orientation, national origin, disability, age, or other protected characteristic;
4. depicts or solicits child sexual abuse material, or otherwise exploits or endangers minors;
5. promotes or facilitates self-harm, violence, terrorism, or other serious physical harm;
6. contains malicious code, including viruses, worms, Trojan horses, ransomware, or other code designed to disrupt, damage, or gain unauthorized access to a system; or
7. is subject to obligations of confidentiality owed to a third party where the third party has not consented to its submission to the Services.

3. Prohibited activities

You may not, and may not authorize or assist any third party to:

1. reverse engineer the Services, the AI Features, model weights, System Prompts, or any other component of the Services, or attempt to derive any of the foregoing from Inputs or Outputs;
2. perform any unauthorized security testing, vulnerability scanning, penetration testing, or red-team activity against the Services, Section's infrastructure, or any Sub-processor's infrastructure;
3. scrape, harvest, or otherwise extract Outputs at scale, by automated means or otherwise, including to train, evaluate, or benchmark a competing artificial-intelligence product or service;
4. submit prohibited data, including protected health information, government-issued identifiers (such as Social Security numbers, passport numbers, or driver's license numbers), financial account or payment card data, biometric data, or sensitive personal data as defined under applicable Data Protection Laws;
5. submit another person's data without a lawful basis or consent sufficient under applicable Data Protection Laws;
6. bypass or attempt to bypass rate limits, authentication, access controls, usage caps, or any other technical or contractual restriction on use of the Services;
7. use the Services to develop, train, fine-tune, or evaluate a competing artificial-intelligence product or service, whether by using Outputs as training data or by other means;
8. use the Services to send unsolicited commercial messages, conduct deceptive or fraudulent marketing, or impersonate any person or entity;
9. interfere with or disrupt the integrity or performance of the Services or the data they contain; or
10. violate applicable law, including U.S. export controls and sanctions laws administered by the Bureau of Industry and Security ("BIS") and the Office of Foreign Assets Control ("OFAC"), anti-bribery, consumer protection, and data protection laws. Without limiting the foregoing, you may not access or use the Services if you are located in, ordinarily resident in, or under the control of any country or territory subject to a comprehensive U.S. trade embargo or stringent U.S. sanctions (which, as of the Last Updated date above, include Belarus, Cuba, Iran, North Korea, Russia, Syria, the Crimea region of Ukraine, the Donetsk People's Republic region of Ukraine, and the Luhansk People's Republic region of Ukraine), and you may not use the Services for any end-use prohibited by Part 744 of the Export Administration Regulations, including (a) missiles, rocket systems, or unmanned air vehicles, (b) chemical or biological weapons, (c) sensitive nuclear end-uses, (d) military or military-intelligence end-uses or by military or military-intelligence end-users, or (e) advanced semiconductor or supercomputer end-uses.

The obligation to apply human review before relying on Outputs in employment, legal, medical, financial, or other high-stakes decisions is a Customer responsibility set out in section 9 of the AI Addendum, and is not duplicated here.

4. Enforcement

Section may investigate suspected violations of this AUP. Where Section reasonably believes a violation has occurred or is occurring, Section may, in its discretion and to the extent permitted by the MSA:

1. throttle, suspend, or terminate the affected user's access or the affected feature;
2. remove or disable access to content that violates this AUP; and
3. for material violations, suspend or terminate Customer's account, with notice to Customer as soon as practicable.

Where a violation creates an imminent risk to the Services, other customers, or any individual, Section may act first and notify Customer after.

5. Reporting

Suspected violations of this AUP, including abusive content, fraudulent activity, or unauthorized access, may be reported to legal@sectionai.com. Security vulnerabilities should additionally be reported to security@sectionai.com.

6. Compliance with law

You remain responsible for your own compliance with all applicable laws when using the Services. Nothing in this AUP transfers responsibility for your compliance with law to Section.

7. Updates

Section may update this AUP from time to time. Material changes will be reflected in the Version and Last Updated date above and, where appropriate, communicated to Customer administrators in product.
